SMS Messaging Terms & Compliance
1. Program Description: This messaging program sends appointment confirmation and reminder messages to customers who have booked an appointment with Straxor through our website at straxor.com, or via our scheduling forms, and have explicitly opted in to receive SMS notifications. Messages include scheduling confirmations, appointment reminders, rescheduling updates, and customer support communications. We only send these messages where you have agreed to receive them.
2. Cancellation Instructions: You can cancel the SMS service at any time. Simply text "STOP" to the same number that sent you messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. Unsubscribing is free of charge, and requests are actioned immediately and in any case within the five (5) business days required under the Spam Act 2003 (Cth). To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
3. Support Information: If you experience issues with the messaging program, reply with the keyword "HELP" for more assistance, or reach out directly to info@straxor.com.
4. Carrier Liability: Carriers are not liable for delayed or undelivered messages.
5. Message & Data Rates: Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your mobile or data plan, contact your mobile service provider.
6. Supported Carriers: Our SMS program works with all major Australian mobile networks, including Telstra, Optus, and Vodafone (TPG Telecom), along with most mobile virtual network operators (MVNOs) operating on those networks.
7. Age Restriction: You must be 18 years or older to participate in our SMS program.
8. Privacy Policy: For privacy-related inquiries, please refer to our Privacy Policy at straxor.com/privacy
We comply with all applicable laws and regulations regarding the use of SMS communications, including the Spam Act 2003 (Cth), the Spam Regulations 2021, the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and applicable ACMA industry codes. All commercial electronic messages we send identify Straxor as the sender and include a functional unsubscribe facility.

Our Limited License to You
This Site and all the materials available on the Site are the property of Straxor and/or our affiliates or licensors and are protected by copyright, trade mark, and other intellectual property laws, including the Copyright Act 1968 (Cth) and the Trade Marks Act 1995 (Cth). The Site is provided solely for your personal non-commercial use.
You may not use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorised by us.
Unless explicitly authorised, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium any material from the Site. However, you may download and/or print one copy of individual pages for your personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices. Nothing in these Terms limits any right you have to deal with material under the fair dealing provisions of the Copyright Act 1968 (Cth).
Your License to Us
When you send us material through the Site or other channels, such as an enquiry, booking notes, comments or feedback, you confirm that you are entitled to share it. You allow us to use, store and copy that material only as needed to respond to you, provide and improve our services, and meet our legal obligations. We will not sell your material, and we handle any personal information in it in accordance with our Privacy Policy.
Disclaimers
Throughout the Site, we may provide links and pointers to Internet sites maintained by third parties. Our linking to such third-party sites does not imply an endorsement or sponsorship of such sites or the information, products, or services offered on or through the sites.
Australian Consumer Law
Nothing in these Terms of Service excludes, restricts, or modifies any guarantee, right, or remedy you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law where to do so would be unlawful.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem rectified in a reasonable time and, if this is not done, to cancel the contract and obtain a refund for the unused portion.
Subject to the paragraph above, the information, products, and services offered on or through the Site are provided "as is" and without warranties of any kind, either express or implied, and to the fullest extent permitted by law we disclaim all such warranties. Where we are permitted to limit our liability for breach of a consumer guarantee, our liability is limited, at our option, to resupplying the services or paying the cost of having the services resupplied.
Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Straxor, its affiliates, and their respective officers, directors, agents, and employees from any claims, causes of action, damages, liabilities, costs, and expenses arising out of or related to your breach of any obligation, warranty, or representation under these Terms of Service. This indemnity does not apply to the extent that the relevant loss was caused or contributed to by our own negligence, breach, or wrongful act.
AI Agents and Website Tools
Some of our phone, messaging, email and chat responses are provided by AI agents. Their responses are automated, may occasionally be inaccurate or incomplete, and are not professional, legal or financial advice. Please confirm anything important with a member of our team.
The Missed Opportunity Calculator and similar tools on the Site provide illustrations only, based on the figures you enter. They are not forecasts, quotes or guarantees of any result.
Online Commerce
Certain sections of the Site may allow you to purchase products and services from third-party vendors. To the extent permitted by law, we are not responsible for the quality, accuracy, timeliness, reliability, or any other aspect of these products and services. If you make a purchase from a third party linked through the Site, the information obtained during your visit, including payment information, may be collected by both the merchant and us, and will be handled in accordance with our Privacy Policy.
Your participation in any dealings with third-party vendors is solely between you and the third party. To the extent permitted by law, Straxor shall not be responsible for any loss or damage incurred as a result of such dealings.
Registration & Passwords
To access certain features of the Site, you may be required to register and create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
If you suspect unauthorised use of your account, notify us immediately at info@straxor.com. To the extent permitted by law, we are not liable for any loss or damage arising from your failure to comply with this obligation.
Termination
We reserve the right to terminate or suspend your access to the Site if we determine, acting reasonably, that you have violated these Terms of Service or engaged in conduct that is inappropriate or unlawful. Where practicable and where it is reasonable to do so, we will give you notice before suspending or terminating your access. Upon termination, you must cease all use of the Site and any content obtained from it.
Governing Law & Dispute Resolution
These Terms of Service are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia. You and Straxor submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.
Nothing in this section limits any right you may have to bring proceedings in the courts or tribunals of the state or territory in which you are ordinarily resident, or to rely on the consumer protection laws of that state or territory where those laws apply to you.
If a dispute arises, we ask that you contact us first at info@straxor.com so we can attempt to resolve it informally. If the dispute is not resolved within thirty (30) days, either party may pursue mediation or such other dispute resolution process as the parties agree, before commencing court proceedings.
Nothing in this section prevents you from making a complaint to a regulator, including the Australian Competition and Consumer Commission (ACCC), the consumer affairs or fair trading body in your state or territory (such as NSW Fair Trading, Consumer Affairs Victoria, or the Office of Fair Trading in Queensland), the Office of the Australian Information Commissioner (OAIC), or the Australian Communications and Media Authority (ACMA), or from commencing proceedings in a court or tribunal that has jurisdiction.
